Form 8849 Refunds for Carriers and Which Claims Qualify

Form 8849 Refunds for Carriers and Which Claims Qualify

You sold one truck in March, another was totaled in April, and the HVUT on both is already with the IRS. Form 8849 is the IRS claim for refund of excise taxes a business already paid, filed with the schedule that matches the refund. Your refund situation decides which schedule you file, when you can file, and whether a credit on your next Form 2290 beats a refund.

Key takeaways Most carrier claims go on Schedule 6. Sold, destroyed, or stolen trucks qualify only before June 1. A refund is income if you deducted the tax.

Which Form 8849 Schedule Fits Your Refund

The schedule you attach carries the claim. Schedules 2, 5 and 8 serve fuel vendors and card issuers, so carriers use two:

  • Schedule 6, other claims, including refunds of tax paid on Form 2290.

  • Schedule 1, fuel put to a nontaxable use.

Skip Schedule 3. The May 2026 Form 8849 instructions say its payments expired after 2024. For the basics, see how Form 2290 HVUT works.

Schedule 6 for Trucks Sold, Destroyed, or Stolen

The pro rata refund applies only when the truck was sold, destroyed, or stolen before June 1 of the period (July 1 to June 30) and wasn't used for the rest of it. The registered owner at the time files. Per the Form 2290 instructions, "destroyed" means not economical to rebuild.

Attach these, per the Schedule 6 instructions:

  1. The VIN and taxable gross weight category.

  2. Whether the truck was sold, destroyed, or stolen, and the date.

  3. Your refund computation, per the Form 2290 line 5 instructions.

  4. The buyer's name and address, for any sale on or after July 1, 2015.

The disposal also hits your books, much like booking truck depreciation correctly.

Schedule 6 for Low-Mileage Trucks and Overpayments

If you paid the tax and the truck ran 5,000 public-highway miles or less (7,500 agricultural), you can claim a refund. The limit counts miles across all owners.

The catch is timing. You can't file until after June 30 of the period.

A truck reported as suspended (category W) paid no tax, so there's nothing to refund. This refund applies only when tax was paid and the truck then stayed under the limit.

Mistaken Form 2290 overpayments are claimed by whoever paid.

Refund on Form 8849 or Credit on Your Next Form 2290

Per the Form 2290 instructions, a sold, destroyed, or stolen credit goes on your next Form 2290, and a low-mileage credit on the next period's first Form 2290.

  • Take the refund if you need cash now or have no return coming.

  • Take the credit if you're filing anyway.

  • The credit can't exceed the tax on that return. Excess goes on Schedule 6.

Never claim the same amount both ways.

Schedule 1 for Diesel Used Off the Highway

Per the IRS Schedule 1 instructions, the ultimate purchaser claims undyed diesel on line 3a at $.243 per gallon, type of use 2, off-highway business use.

IRS Publication 510 counts a separate refrigeration unit motor as off-highway use, but fuel through the truck's own engine or power take-off doesn't qualify.

Those instructions require a $750 minimum, filed in the quarter after the last one claimed, once per quarter. Below that, claim annually on Form 4136. Pull gallons from your fleet fuel card program, the same data behind IFTA fuel tax reporting.

Form 8849 Deadlines, E-Filing and Processing Time

Per the Schedule 6 instructions, file within 3 years of filing the return or 2 years from paying the tax, whichever is later. The claim needs your EIN, covered in EIN vs TIN for trucking businesses.

E-filing is optional and runs through an IRS-approved provider for a fee. The IRS e-file FAQ confirms paper is still accepted, and paper Schedules 1 and 6 go to Cincinnati, OH 45999-0002.

The IRS says e-filed Schedule 6 claims are processed within 45 days of acceptance.

Records to Keep and How to Book the Refund

Keep every record in the table for 3 years after the tax is due or paid, whichever is later, per the Form 2290 instructions.

The Form 8849 instructions say a refund is gross income if you deducted the tax, and HVUT usually sits among deductible trucking business expenses. Cash-method filers include it in the year received, and cash vs accrual accounting for trucking covers how accrual differs.

Before you file Schedule 6 Confirm tax was paid, not suspended. Check the June 1 or June 30 date. Rule out an existing Form 2290 credit.

Where Fintruck Fits

Fintruck is AI-native accounting built for trucking from day one. It doesn't file Form 8849 or act as an e-file provider.

It keeps the HVUT expense, the truck disposal and the refund on the right accounts in your trucking chart of accounts, so each claim is documented.
